DUI and hit-and-run case dismissed against immigrant in U.S. illegally

An immigrant in the country illegally who was tried twice on charges of driving while drunk and causing a crash in San Ysidro that seriously injured a 6-year-old boy will not be tried a third time, a judge ruled Friday.

The case against 39-year-old Constantino Banda Acosta, a Mexican citizen who has been deported from the United States more than a dozen times, was dismissed.

Chula Vista Superior Court Judge Stephanie Sontag had declared a mistrial on Monday after jurors informed her they were unable to reach verdicts on the felony charges, including hit-and-run causing serious injury and driving under the influence of alcohol.

So the six-year old kid he hit fractured his own skull?

In September, a different jury that had heard the case announced that it was deadlocked on the felony charges, but convicted him on misdemeanor counts of vandalism, battery, and driving without a license.

Sontag on Friday sentenced Banda on the three misdemeanor convictions, giving him credit for the more than two years of time he has already served while going through the two trials.

Deputy Dist. Atty. Christopher Chandler said immigration authorities had placed a hold on Banda so that he is not released from custody before federal prosecutors decide whether to pursue charges.

Banda was arrested after the May 6 crash that left then-6-year-old Lennox Lake with serious injuries, including a fractured skull. The family had been returning home to San Ysidro from a trip to Disneyland.

The case drew national interest after federal authorities said Banda had repeatedly crossed the border illegally. He had been deported to Mexico or allowed to return there voluntarily 17 times since 2002, according to records from the U.S. Department of Homeland Security.

Chandler argued in both trials that Banda was behind the wheel of a Chevrolet Silverado when he ran a stop sign and broadsided the Lake family's Honda Accord.

Banda was in the driver's seat of the pickup when Border Patrol agents pulled him from the vehicle less than two miles from the crash site.

Deputy Public Defender Juliana Humphrey contended that another man, Jorge Adame Ariza, was driving at the time of the crash.

Surveillance video shows Adame behind the wheel of the pickup earlier that evening when the pair left a Chula Vista restaurant.

Humphrey argued that police assumed too quickly that Banda was the driver, and they didn't question Adame until three days after the crash.

Chandler has said that Banda and Adame switched seats before the crash because Adame did not have a driver's license. Adame, who was in the country illegally, also testified that it was Banda who ran a stop sign and struck the Lake family's car.

I'm still trying to find out what he was arrested for. 10-to-1 it was for using a crowbar instead of a key to gain access to a car.

The caller who summoned police said a male subject had broken car windows with a crowbar and was now hiding in a backyard. The suspect was described as a thin 6-foot-1 man wearing a black hoodie and dark pants.

Police have released shocking video that shows the moment cops shot dead an unarmed father-of-two in his own backyard.

Officers fired 20 times at Stephon Alonzo 'Zoe' Clark, after chasing him through the streets at night, into the backyard of his grandparents' house, where he'd been staying. Clark, 23, died at the scene.

Police bodycam footage captured the moment that officers turned around the corner of a house, where they came across Clark.

Backing up, behind the corner, one of the cops was heard shouting 'Gun! Gun! Gun!' and shouted once 'Show me your hands', before his partner yelled: 'Get 'em, get 'em get 'em.'

Almost immediately, they both opened fire, reigning down a hail of 20 bullets in a matter of seconds. 

As Clark lay dying on the ground, the officers yelled at him to 'show me your hands!'

At no time in the clip were they heard to identify themselves as police officers.

As backup arrived, one of the officers says he thought that Clark had a weapon.

'He came up, and then he kind of approached us hands out, and then he fell down,' one of the officers said as fellow cops called out to Clark, to ask if he could move.

Two officers are then seen moving up the side of the house and confront him



Moments later, they opened fire and Clark collapsed to the ground



As Clark lay dying on the ground, the officers yelled at him to 'show me your hands!'

One of the responding officers said he saw 'something in his hands - it looked like a gun from our perspective.'

'He was still pointing when I saw him again.' 

When back up officers later rolled Clark over to handcuff him, no gun was found. Only a cellphone could be seen lying nearby.

Neither of the officers involved in the shooting have been identified. 

Another clip, taken from the police helicopter and shot in infrared, shows Clark jumping a neighbor's fence to get into his family's backyard.

Two officers are then seen moving up the side of the house and confront him.

Moments later, they opened fire and Clark collapsed to the ground.

Police said they shot and killed him because he was walking towards them holding an object, which they believed was a gun, and feared for their safety.

Investigators only found a cell phone near his body after he was gunned down. 

Dozens of people carrying signs and calling for police accountability took to the streets on Monday night to protest Clark's shooting.

Trump attacks 'crazy Joe Biden' after the former VP said he would have 'beat the hell out of' Trump for disrespecting women



President Donald Trump is lashing out at Joe Biden for wanting to "beat the hell out of him," saying the former vice president "would go down fast and hard, crying all the way."

The Republican president tweeted Thursday: "Crazy Joe Biden is trying to act like a tough guy. Actually, he is weak, both mentally and physically, and yet he threatens me, for the second time, with physical assault. He doesn't know me, but he would go down fast and hard, crying all the way. Don't threaten people Joe!"



Biden spoke at an anti-sexual assault rally in Florida on Tuesday and cited lewd comments Trump made in a 2005 "Access Hollywood" tape about grabbing women.

The Democrat said, "If we were in high school, I'd take him behind the gym and beat the hell out of him."

A Minneapolis police officer who shot and killed an Australian woman in July has been booked on charges of third-degree murder and second-degree manslaughter. 


Officer Mohamed Noor turned himself in on Tuesday after a warrant was issued for his arrest in the death of Justine Ruszczyk Damond. Damond was shot on 15 July, minutes after she called 911 to report a possible sexual assault in the alley behind her home.

The 40-year-old life coach was engaged to be married.

Damond’s family said in a written statement the charges were “one step toward justice”, and said they were pleased the Hennepin county attorney Mike Freeman had decided to bring charges. They said they hoped a strong case would be presented and Noor would be convicted.

“No charges can bring our Justine back,” they said. “However, justice demands accountability for those responsible for recklessly killing the fellow citizens they are sworn to protect, and today’s actions reflect that.”

Freeman was scheduled to discuss charges in the case at an afternoon news conference.

A policeman who was with Noor at the time of the shooting, Matthew Harrity, told investigators he was startled by a loud noise right before Damond approached the driver’s side window of their police SUV. 

Harrity, who was driving, said Noor then fired his weapon from the passenger seat. Damond died of a gunshot wound to the abdomen. 

The officers did not turn on their body cameras until after the shooting, and there was no squad camera video of the incident. 

The lack of video was widely criticized, and Damond’s family members were among the many people who called for changes in procedure, including how often officers are required to turn on their cameras. 

The shooting also prompted questions about the training of Noor, a two-year veteran and Somali American whose arrival on the force had been celebrated by city leaders and Minnesota’s large Somali community. 

Noor, 32, had trained in business and economics and worked in property management before becoming an officer. 

Noor has not talked publicly about the case and declined to be interviewed by state investigators. 

If convicted of third-degree murder, he could face a maximum of 25 years in prison, though the presumptive sentence is 12 years. A judge could issue a sentence ranging from about 10 to 15 years. 

The second-degree manslaughter charge carries a maximum sentence of 10 years in prison, but the presumptive sentence is four years. The jail set bail at $500,000, according to jail records.

In Austin TX a bomb went off from a trip wire by two people riding bikes. The bomber had no idea who it would be.

The last bomb went off at a FedEx distribution facility in Scherzo, Texas, just after midnight on Tuesday. Again the bomber had no idea who it would injure or kill.

Oh...and one other thing. The bomber is probably a strict believer in gun control which caused him to resort to building bombs.

Jim Carrey criticized for portrait believed to be Sanders



LOS ANGELES — Jim Carrey is being criticized on social media for a portrait he painted that is believed to be White House Press Secretary Sarah Huckabee Sanders.




Some Twitter users accused Carrey of shaming because of the unflattering portrait. Others were critical of his use of Christian.

A spokeswoman for Carrey confirms it is his painting. But she would not confirm it is Sanders.

The White House has not returned a message seeking comment.

This is coming from Brennan???

What we have here is the end result of Brennan’s public comments, McCabe’s leaks, and the whole sorry saga of Hillary Clinton’s non-investigation. Our government is so f-ing dirty it's scary to think about it. This is what Trump has been saying all along. The senior leadership of the intelligence and federal law enforcement services are corrupt. Brennan's tweet confirms it. He tries to wrap it in his patriotic bullshit which everyone knows is a lie. It's simple, their plan to get Hillary elected backfired and now they're left holding the bag with a lot to account for. 

BTW... the 'dustbin of history' will be the final resting place for Brennan and his career. Hopefully, he and the rest of his crew Comey, McCabe, Strock, etc will be behind bars soon.

Strock's text messages should have sealed the deal. He hated Trump with a passion and coincidently led the investigation of Clinton. How convenient. You see, when you lie to the FBI you go to jail. But if you work for the FBI and lie that's a whole other matter it.

Trump to seek death penalty for drug dealers




Wouldn't be a stretch to say Barry put him in this position.


The headlines below are just a fraction of the thousands of drug dealers and other nefarious types who were released during the Obama administration. Even his best pal and frequent visitor at the WH Shawn Corey Carter aka Jay-Z used to be a 'pharmacist'.





Most of those jailed were black. He had an aversion to that. Same with the Muslims terrorist he let go at Gitmo.

Washington (AFP) - US President Donald Trump will present on Monday his plan to combat an opioid abuse epidemic which will include seeking the death penalty for drug traffickers.

The Department of Justice "will seek the death penalty against drug traffickers, where appropriate under current law," a White House official indicated Sunday whilst outlining the plan's main points.

The official did not offer greater detail on how the death penalty could be invoked against drug dealers without amending statutes.

Trump is due to unveil his plan in a speech in Manchester, New Hampshire, a state hard hit by the crisis.

An estimated 2.4 million Americans are addicted to opiates, the narcotics that include prescription painkillers, as well as heroin.

Nationwide, emergency room visits for overdoses from drugs like heroin, fentanyl and prescription painkillers up 30 percent from 2016 to 2017, the Centers for Disease Control and Prevention said earlier this month.

The report found that from July 2016 to September 2017, a total of 142,557 emergency room visits were due to suspected opioid overdoses.

Trump has previously mooted the "ultimate" punishment for drug dealers and is said to have spoken in glowing terms about the policies of deeply controversial Filipino leader Rodrigo Duterte, who has ordered extra-judicial killings of traffickers.

"If you shoot one person, they give you life, they give you the death penalty. These people [who sell drugs] can kill 2,000, 3,000 people and nothing happens to them," he said.

Many opposition Democrats oppose the idea of executing drug dealers, and changing the law would require an act of Congress.

"We will not incarcerate or execute our way out of the opioid epidemic," said Democratic Senator Ed Markey last week.

"Extreme proposals like using the death penalty only perpetuate a harmful stigma associated with opioid use disorders and divert attention from meaningful conversations and progress on expanding access to treatment, recovery, and other public health initiatives," he said.

Illegal Alien Acquitted of Murdering Kate Steinle Sues Feds for ‘Vindictive Prosecution’





In November, a San Francisco jury found Garcia-Zarate not guilty of murdering Steinle, agreeing that although he had the gun from which the fatal shot was fired, the discharge could have been accidental.

The jury did convict Garcia-Zarate of felony possession of a weapon. He had seven previous felony convictions and had been deported five times before finding “sanctuary” on the streets of San Francisco, a noted “sanctuary city.”

The federal government immediately issued a warrant for Garcia-Zarate’s arrest for violating the terms of his 2015 federal prison release. It then charged him with federal crimes — “for being a felon in possession of a firearm and ammunition, and for being an illegally present alien in possession of a firearm and ammunition.”

As reported by CourthouseNews.com, Garcia-Zarate is alleging “that federal agencies colluded with the San Francisco police, district attorney’s office, and sheriff’s office” and that he is being subjected to double jeopardy — being tried for the same crime twice.

In the motion, filed Tuesday, Garcia-Zarate’s attorney complains: “Almost immediately after the death of Ms. Steinle, then-presidential candidate Donald Trump began to use Mr. Garcia-Zarate as the symbol of the dangers of illegal immigrants and the need for a wall between the United States and Mexico.” The attorney also cites several tweets by President Donald Trump as proof that his client is being subjected to unfair treatment.


The federal charges that follow, the attorney argues, violate Garcia-Zarate’s rights to due process: “Though broken up into two counts, these allegations address the exact same conduct as that for which he was convicted in San Francisco.”

To prove his case of “vindictive prosecution” and collusion between state and federal law enforcement, Garcia-Zarate is demanding all records of communication between federal, state, and local law enforcement about the case.

Ironically, California is currently battling the federal government over state laws that restrict cooperation and communication between state and local government with federal immigration officials.

An Ohio high school student said he tried to stay apolitical during the National Walkout Day over gun violence but was suspended for his choice to remain in a classroom instead of joining protests or the alternative, going to study hall.

Jacob Shoemaker, a senior at Hilliard Davidson High School, said he didn’t want to take sides in the gun-control debate consuming the country. If he went outside for the walkout, he said, he would be supporting gun control. If he stayed in the common area of the school, he said, he would be seen as supporting gun violence and disrespecting the 17 lives lost in the Parkland, Fla. High school shooting the month before.

Jacob had met with the school’s principal on Tuesday, a day before the rally, for about an hour to find out what exactly the walkout was supporting. But he said the principal reportedly told him it was for the “students to express themselves.”


This left Jacob wondering if it was a memorial for the lives lost or a show of support for gun control.

He decided, instead, to stay in class for about 20 minutes doing homework after his teacher and fellow classmates left and locked the door.

When they returned, he was slapped with a suspension.

Jacob’s father, Scott Shoemaker, said his son was just trying to stay neutral – and did nothing wrong.

“Politics [doesn’t] belong in the school,” he said. “Students shouldn’t be pressured into taking a side.”


The story went viral after Jacob sent a photo of his out-of-school suspension citation to one of his friends, who posted it on social media.

The school, as well as the Shoemakers, have received death threats and hate messages.

Scott Shoemaker said his son was just trying to be introspective – and he wasn’t acting out.

“He didn’t do anything to deserve this,” he said. “He didn’t ask for this.”


The district says it's responsible for students' safety and they can't be unsupervised.

PS: If I was this kid's father I would sue the f-ing school.
