The Prosecutor

Prosecutor Joe Magats (so apropos) said he thought Jussie Smollett was guilty but  'based on the facts and circumstances' of the case and 'based on his lack of criminal background', the decision was made 



If  'facts and circumstances' hold any significance Smollett should be behind bars.

I would scrutinize the hell out of this guy. 

1. Check his phone records

2. Check his bank account

3. Check his balls... if the above comes up negative he doesn't have any
